Terms of Service

1. Acceptance of Terms

By accessing or using the website aimockupgenerator.co ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Hypothesis One LLC ("Company," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years old to use this Service. By creating an account, you warrant that you are of legal age to form a binding contract and meet all eligibility requirements.

3. Account Registration

To access features, you must register for an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials (managed via Supabase Auth and Google OAuth) and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription and Credit System

4.1. Subscription Plans

The Service is billed on a recurring monthly basis ("Subscription").

• Starter Plan: $29/month (80 credits)
• Pro Plan: $49/month (160 credits)

4.2. Credit Usage

Credits are the currency of the Service:

• 1 Credit: Generates one (1) standard mockup (1K or 2K resolution).
• 1 Credit: Used for one (1) variation or edit of an existing mockup.
• 2 Credits: Generates one (1) high-resolution mockup (4K resolution).

4.3. Rollover and Expiration

Active Subscriptions: Unused credits roll over to the next month as long as your subscription remains active.

Cancellation: If you cancel your subscription, your account will downgrade at the end of the billing cycle. You may retain and use your accumulated credits for 3 months following the date of cancellation. After 3 months, all remaining credits will expire immediately and without refund.

4.4. Payments

Payments are processed securely via Stripe. We do not store your credit card information on our servers. You authorize us to charge your payment method for the subscription fees. All fees are non-refundable unless required by law.

5. Intellectual Property & Content Ownership

5.1. User Obligations (Critical)

You retain full ownership of the images and assets you upload ("User Content"). By uploading User Content, you represent and warrant that:

• You own all rights to the content or have obtained all necessary licenses/permissions.
• Your content does not infringe on the trademarks, copyrights, or intellectual property rights of any third party.
• Your content is not illegal, offensive, or harmful.

Hypothesis One LLC explicitly disclaims all liability for trademark or copyright infringement arising from User Content. You agree to indemnify and hold us harmless against any claims resulting from your violation of this section.

5.2. Generated Mockups

Subject to your compliance with these Terms, Hypothesis One LLC grants you a perpetual, non-exclusive, worldwide, royalty-free commercial license to use, display, and distribute the mockups generated by the Service. You own the final generated image.

6. AI Disclaimer

The Service utilizes third-party artificial intelligence models (provided by Google) to generate images.

• Accuracy: We do not guarantee that generated mockups will be error-free or physically accurate.
• Uniqueness: Due to the nature of AI, it is possible (though unlikely) that similar outputs could be generated for other users providing similar inputs.

7. Prohibited Conduct

You agree not to:

• Upload content that depicts child sexual abuse material (CSAM), violence, or hate speech.
• Reverse engineer or attempt to extract the source code or underlying AI models of the Service.
• Use the Service to create counterfeit goods or misleading product representations.

8. Limitation of Liability

To the maximum extent permitted by law, Hypothesis One LLC shall not be liable for any indirect, incidental, or consequential damages (including loss of data, revenue, or profits) arising out of your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
